İşbu aydınlatma metni 6698 sayılı Kişisel Verilerin Korunması Kanunu (“KVKK”) m.10 uyarınca, müşterilerimizin kişisel verilerinin işlenmesi süreçlerine ilişkin hazırlanmıştır.

Kişisel Veri Nedir?
KVKK uyarınca kişisel veri, kimliği belirli veya belirlenebilir gerçek kişiye ilişkin her türlü bilgidir. Bu kapsamda müşterilerimizin kimlik bilgisi, iletişim bilgisi, talep/şikayet/itibar verisi, risk yönetimi, işlem güvenliği, görsel ve işitsel verileri, müşteri işlem bilgisi, pazarlama verisi ve finansal bilgilerini aşağıda belirtilen amaçlar doğrultusunda KVKK’ya uygun olarak işlemekteyiz.
Kişisel Verilerinizin İşlenme Amaçları Nelerdir?
Elmaksan tarafından elektronik veya fiziki yollarla toplanan kişisel verileriniz:
– Faaliyetlerin mevzuata uygun yürütülmesi,
– Finans ve muhasebe işlemlerinin yürütülmesi,
– Hukuki işlerin takibi ve yürütülmesi,
– Hukuki yükümlülüklerin yerine getirilebilmesi,
– İletişim faaliyetlerinin yürütülmesi,
– İş sürekliliğinin sağlanması faaliyetleri,
– İş ve denetim faaliyetlerinin yürütülmesi,
– İşlem ve hizmet güvenliğinin sağlanması,
– Mal alım, satım, satım sonrası süreçlerine ilişkin faaliyetlerin yürütülebilmesi,
– Müşteri ilişkileri yönetimi süreçlerinin yürütülmesi ve etkin bir müşteri hizmetinin sunulması,
– Risk yönetimi süreçlerinin yürütülmesi,

– Talep ve şikayetlerin takibi,

– Yetkili kişi, kurum veya kuruluşlara bilgi verilebilmesi ile
KVKK’nın 5. ve 6. maddelerinde belirtilen kişisel veri işleme şartları kapsamında işlenecektir.
Kişisel Verilerinizin Toplanma Yöntemi ve Sebebi Nedir?
Kişisel verileriniz Elmaksan ile kurduğunuz sözleşmeler, yaptığınız yazışmalar, sözleşme görüşmeleri, telefon, e-mail ve yahut bilginiz dahilindeki Elmaksan iş ortakları aracılığı ile elektronik veya fiziki yollarla elde edilmektedir.
Fiziki ve/veya elektronik yöntemlerle toplanan kişisel verileriniz KVKK’nın 5. maddesinde yer alan bir sözleşmenin kurulması veya ifası, hukuki yükümlülüğün yerine getirilmesi, ilgili kişi tarafından verinin alenileştirilmesi ve bir hakkın tesisi, kullanılması ve korunması, ilgili kişinin temel hak ve özgürlüklerine zarar vermemek şartı ile Elmaksan’ın meşru menfaatinin gerektirmesi hukuki sebeplerine dayanılarak toplanmaktadır.
İşbu toplama faaliyeti esnasında, ilgili işleme sürecinin KVKK m.4’te yer alan ilkelere ve KVKK m.5’de yer alan şartlara uygun olması için elimizden gelen hassasiyeti gösteriyoruz.
Kişisel Verilerinizin Aktarım Amaçları Nelerdir?
Kişisel verileriniz gerektiğinde ve faaliyetin zaruri kıldığı ölçüde, yurtiçinde ve/veya yurtdışında, Elmaksan’in ticari ve/veya iş stratejilerinin planlanması, sözleşme süreçlerinin yürütülmesi, faaliyetlerin mevzuata uygun yürütülmesi ve icrası, finans ve muhasebe işlerinin takibi, mal alım-satımına ilişkin operasyonel faaliyetlerin yürütülmesi, Elmaksan’ın ve Elmaksan ile iş ilişkisi içerisinde olan ilgili kişilerin hukuki, teknik ve ticari-iş güvenliğinin temini amaçları dahilinde, KVKK’nın 8. ve 9. Maddelerine uygun şekilde ulusal ve uluslararası mevzuat hükümleri çerçevesinde; kişisel verilerin güvenliğini temin eden karşılıklı taahhütler altında EMS Makine Sanayi ve Ticaret Kollektif Şirketi Mustafa El ve Ortağı başta olmak üzere iş ortaklarımız ile, Elmaksan’ın danışmanlık hizmeti aldığı mesleki danışmanlar, muhasebeciler, denetçiler, mali müşavirler, avukatlar, arşiv hizmeti veren kuruluşlar, bilgi teknolojisi uzmanları ile yasal yükümlülüğün yerine getirilebilmesi amacı ile tedarikçilerimiz, hukuken yetkili kurum ve kuruluşlar ve hukuken yetkili özel hukuk tüzel kişileriyle paylaşılabilecektir.
KVKK Kapsamında Haklarınız
KVKK m.11 uyarınca aşağıdaki haklara sahip olduğunuzu belirtmek isteriz:
a) Kişisel veri işlenip işlenmediğini öğrenme,
b) Kişisel verileri işlenmişse buna ilişkin bilgi talep etme,
c) Kişisel verilerin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,
ç) Yurt içinde veya yurt dışında kişisel verilerin aktarıldığı üçüncü kişileri bilme,
d) Kişisel verilerin eksik veya yanlış işlenmiş olması hâlinde bunların düzeltilmesini isteme,
e) 7 nci maddede öngörülen şartlar çerçevesinde kişisel verilerin silinmesini veya yok edilmesini isteme,
f) (d) ve (e) bentleri uyarınca yapılan işlemlerin, kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
g) İşlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle kişinin kendisi aleyhine bir sonucun ortaya çıkmasına itiraz etme,
ğ) Kişisel verilerin kanuna aykırı olarak işlenmesi sebebiyle zarara uğraması hâlinde zararın giderilmesini talep etme.

This customer clarification text has been prepared in accordance with the Article 10 on Personal Data Protection numbered 6698 (“KVKK”), in relation to the processing of our customers’ personal data.
Who is the Data Controller?
Your personal data could be processed by Elmaksan, as being data controller, within the scope described below, pursuant to KVKK. You can access detailed information on the subject from the Personal Data Protection tab on the site www.elmaksan.net.
What is Personal Data?
Pursuant to KVKK, Personal data is any information related to an identified or identifiable real person. In this context, we process our customers’ identity information, contact information, demand/complaint/ reputation data, risk management, transaction security, visual and audio data, customer transaction information, marketing data and financial information in line with the stated purposes below and in compliance with KVKK obligations.
What are the Purposes of Processing Your Personal Data?
Your personal data collected by Elmaksan electronically or physically shall be processed with the purposes indicated below within the scope of Personal Data processing regulations specified in articles 5 and 6 of KVKK.:
– Carrying out the activities in accordance with the legislation,
– Carrying out financial and accounting operations,
– Follow-up and execution of legal affairs,
– Performance of legal obligations,
– Conducting communication activities,
– Activities for ensuring business stability,
– Conducting business and audit activities,
– Ensuring transaction and service security,
– Carrying out activities related to the purchase, sale and post-sale processes,
– Conducting management of customer relationship processes and providing effective customer service,
– Carrying out risk management processes,
– Carrying out contract processes,
– Conducting sponsorship activities,

– Carrying out marketing, advertising and promotion processes of products/services,

– Providing information to authorized persons, institutions or organizations
What is the Method and Reason of Collecting Your Personal Data?
Your personal data could be collected by electronic or physical methods, by means of your contracts entered into with Elmaksan, correspondences you have made, contract negotiations or through telephone, e-mail or Elmaksan business partners within your knowledge.
Your personal data collected by physical and/or electronic methods could be collected with basis of legal reasons stipulated in Article 5 of KVKK; (i) execution of a contract or (ii) fulfilment of the legal obligation, (iii) publication of the data by the relevant person , (iii) establishment, use and protection a right, and (iv) the necessity for Elmaksan’s legitimate interest under the condition that the relevant person’s fundamental rights and freedoms are not damaged.
We are very sensitive to ensure that the relevant processing activities comply with the principles in the Article 4 of KVKK and the conditions in Article 5 of KVKK during this collection activity.
What are the Purposes of Transfer your Personal Data?
Your personal data can be shared with our suppliers, legally authorized institutions and organizations and legally authorized private legal entities, our business partners, especially EMS Makine Sanayi ve Ticaret Kollektif Şirketi Mustafa El ve Ortağı, and Elmaksan’s professional consultants, accountants, auditors, financial advisors, lawyers, institutions providing the archive services and information technology experts as required and to the extent required by the activity for the purposes of Elmaksan’s commercial and/or business strategy planning, execution of contract processes, execution of activities in accordance with the legislation, follow-up of financial and accounting affairs, and operational activities related to the purchase and sale of goods, ensuring the legal, technical and commercial-occupational safety of Elmaksan and related persons who have business relations with Elmaksan under the mutual commitments that ensure the security of personal data within the scope of national and international legislative provisions in accordance with Articles 8 and 9 of KVKK at home and/or abroad.
Your Rights Within the Scope of KVKK
We would like to note that as per the Article 11 of Turkish Personal Data Protection Law, natural persons whose personal data are under process have the right to:
a. Learn whether or not her/his personal data have been processed;
b. Request information as to processing if her/his data have been processed;
c. Learn the purpose of processing of the personal data and whether data are used in accordance with their purpose;
d. Know the third parties in the country or abroad to whom personal data have been transferred;
e. Request the correction of personal data in case that personal data is processed incompletely or inaccurately;
f. Request deletion or destruction of personal data within the scope of the conditions stipulated in Article 7;
g. request notification of transactions made in accordance with clauses (d) and (e) to third parties to whom personal data is to be transferred;
h. Object to occurrence of any result that is to her/his detriment by means of analysis of personal data exclusively through automated systems;
i. Request compensation for the damages in case that the person incurs any damage due to unlawful processing of personal data.

Your request will be concluded free of charge as soon as possible and no later than 30 days.
However, in case the operation necessitates an additional cost, the fee in the tariff designated by the Board of The Protection of Personal Data may be requested.
